The applicant has also planted 80 evergreen trees, six feet tall, along the east and south property lines with <br /> plans for another 150 trees later this year. The trees are intended to screen the storage area from adjacent <br /> properties. The topography of the site screens the business operations from view along 207 I Avenue. To <br /> ensure noise does not become a concern, staff recommends following the MPCA noise pollution <br /> guidelines for residential uses. <br /> Public Hearing <br /> During the July 28, 2015,public hearing a number of residents from the area came to the meeting and <br /> expressed concern about the application. Their concerns included the amount of outdoor storage, <br /> screening, and noise. Many of the residents stated they can see the outdoor storage area from their homes <br /> and they do not believe it fits the character of a residential neighborhood. The applicant answered the <br /> questions regarding business operations and addressed the outdoor storage question by explaining they <br /> have plans to move all storage indoors. <br /> During the August 25, 2015, public hearing, the property owner spoke in response to a number of <br /> questions from the previous meeting and stated they have significantly reduced their need for outdoor <br /> storage and consolidated what outdoor storage is required. A resident requested the Planning <br /> Commission change the Saturday hours of operation from 9 a.m. to noon, to noon and later. <br /> Planning Commission <br /> On July 28, 2015, the Planning Commission reviewed the conditional home occupation request and <br /> expressed concern about the size of the proposed 63,000 square foot outdoor storage area. The applicant <br /> requested additional time to revise their plans and address some of the concerns identified during the <br /> public hearing. <br /> After noting the significant reduction in outdoor storage, the Planning Commission recommended <br /> approval of the application 5-0 during their August 25, 2015, meeting. The commission did not make any <br /> changes to the proposed hours of operation. <br /> Applicable Regulations <br /> Home Occupations <br /> The application does not include any prohibited activities associated with a home occupation. However, <br /> the request does not meet a number of the requirements for a permitted home occupation,requiring a <br /> CUP per Sec. 30-801 (d). <br /> Conditional Use Permit <br /> The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br /> (1) 1Vill not endanger, injure or detrimentally affect the use and enjoyment of otberpropegy in the immediate <br /> vicinity or the public health, safety, morals, comfort, convenience orgeneral nvr fare of the neighborhood or the city. <br /> (2) 1Vill be consistent Pith the comprehensive plan. <br /> (3) 1Vill not impede the normal and orderly development and improvement of surrounding vacantproperty. <br /> (4) 1Vill be served adequately by and Pill not adversely affect essential public facilities and services including <br /> streets,police and fire protection, drainage, refuse disposal, Pater and sorer systems,parks and schools;and <br /> Pill not, in particular, create traf c congestion or interference Pith traf c on adjacent and neighboring public <br /> thoroughfares. <br /> (5) 1Vill not involve uses, activities,processes, materials, equ pment and conditions of operation that Pill be <br /> detrimental to any persons orpropegy because of excessive traffic, noise, smoke,fumes,glare, odors, dust or <br /> vibrations. <br /> N:APublic Bodies\Agenda Packets\09-21-2015\Final\7.3 sr Plant Place CUP.docx <br />
