Trout Brook Estates <br />July 14, 2004 Page 2 <br /> <br />extension is necessary to begin to complete the loop through the area of the River Park <br />development and on down County Road 40 to CSAH 12. <br /> <br />An access onto CSAH 13 was thoroughly discussed at the Planning Commission <br />meeting. It was determined that its current location is the best for a geometric <br />improvement to Tyler Street on the northwest side of CSAH 13 to create a 4-legged 90- <br />degree intersection. As indicated in my memo of June 17th, we would recommend that <br />the developer be obligated to obtain the land from the private party on the north side of. <br />CSAH 13 and undertake the necessary geometric improvements to existing Tyler Street <br />to create the 4-legged 90-degree intersection. It is important to note that this condition <br />needs to be backed by the City Council's willingness to use its power of eminent domain <br />to ultimately acquire the necessary property from the north side of CSAH 13 for the <br />realignment of Tyler Street, if the developer's negotiations with the landowner is <br />unsuccessful. <br /> <br />We have discussed with the developer the potential need for a temporary access onto <br />CSAH 13 to initiate the marketing of the first phase, if the realigned final interseCtion is <br />not accomplished due to holdups in land acquisition. <br /> <br />you have any questions regarding any of these comments, please call. <br /> <br />Sincerely, <br /> <br />Howard R.
