ORDINANCE 00- <br /> <br /> AN ORDINANCE OF THE CITY OF ELK RIVER <br /> <br /> AN ORDINANCE AMENDING SECTION 502 OF THE ELK RIVER <br /> CITY CODE ENTITLED "DOGS AND OTHER ANIMALS" <br /> <br /> The City Council of the City of Elk River does hereby ordain as <br />follows: <br /> <br /> Section 1. Section 502 of the City of Elk River Code of Ordinances <br />titled "Dogs and Other Animals" is hereby amended as follows: <br /> <br /> Section 2. Section 502.00, titled "Definitions" is hereby amended by <br />deleting the definition "Under Restraint" as follows: <br /> <br />502.00 - DEFINITIONS <br /> <br /> Section 3. Section 502.07 titled "Removal of Animal Feces" is hereby <br />added as follows: <br /> <br />502.07 - REMOVAL OF ANIMAL FECES <br /> <br />1. Any person having the custody or control of any dog or <br /> <br />domestic animal shall have the responsibility for cleaning up any <br />feces of the animal and disposing of such feces in a sanitary <br />manner. It shall furthermore be the duty of any person having <br />custody or control of any dog or domestic animal on or about any <br />public place to have in such person's possession suitable <br />equipment for the picking up, removal, and sanitary disposal of <br />animal feces. The provisions of this paragraph shall not apply to <br />a guide dog accompanying a blind person or to a service dog <br />accompanying a disabled person or to a dog when used in police or <br />rescue activities. Every person convicted of a violation of this <br />provision shall be punished by a fine of not more than one <br /> <br />hundred dollars ($100.00). <br /> <br />2. The provisions of this section shall not apply to the <br /> <br />ownership or use of seeing eye dogs by blind persons, dogs used <br />in police activities of the city, such as the canine corps, or <br /> <br /> <br />
