TO MIDNIGHT IN CONJUNCTION WITH THE FIRE DEPARTMENT DANCE - <br />APPROVED <br />PROCLAMATION PROCLAMING SEPTEMBER 17 THROUGH SEPTEMBER 23, <br />2000 AS CONSTITUTION WEEK - APPROVED <br /> <br />COUNClLMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />4. Open Mike <br /> <br />No one appeared for open mike. <br /> <br />5.1. Consider Amendment to Animal Ordinance <br /> <br />Police Chief Tom Zerwas indicated that the amendment to the animal ordinance <br />is an attempt to address citizen concerns regarding regulation of animal feces <br />and dogs on leashes in public places. He explained that the amendment requires <br />dogs to be on an 8-foot leash while in any public place. The amendment also <br />requires the person in custody of the dog having the responsibility of cleaning up <br />and disposing of animal feces in a sanitary manner. <br /> <br />Discussion was held regarding enforcement of the ordinance and the length of <br />the dog leash. Councilmember Motin indicated that the law does not address <br />retractable leashes. The Council questioned whether the ordinance addressed <br />dogs running at large on private property. It was the consensus of the council to <br />amend the language by adding "or private property of another" to 502,07 (1). <br /> <br />COUNCILMEMBER THOMPSON MOVED TO ADOPT ORDINANCE 00-15 AN <br />ORDINANCE AMENDING SECTION 502 OF THE ELK RIVER CITY CODE ENTITLED DOGS <br />AND OTHER ANIMALS. COUNClLMEMBER FARBER SECONDED THE MOTION. THE <br />MOTION CARRIED 4-1. COUNClLMEMBER MOTIN OPPOSED. <br /> <br />5.2, <br /> <br />Councilmember Motin indicated that he voted against the motion as he feels it <br />infringes into the public's private realm. <br /> <br />Consider YMCA Letter Requestin.q Feasibility Study <br /> <br />The city administrator distributed the proposal for a feasibility study for the YMCA <br />facility locating in the city of Elk River. He noted that the city would be responsible <br />for one-half of the cost, which is $21,5[]0 plus expenses. <br /> <br />COUNClLMEMBER FARBER MOVED TO PARTICIPATE IN THE YMCA COMMUNITY <br />RESEARCH STUDY. COUNCILMEMBER MOTIN SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />5.3A. Consider Bud,qet Debt Service Levy Adjustments <br /> <br />The city administrator reviewed the results of the 9/6/00 council worksession on <br />the budget and tax levy. He noted that the proposed budget stands at <br />$6,470,000 and the net levy at $4,457,247. <br /> <br /> <br />
