80710 <br /> <br />construction contract and the performance of the contract <br />construction, comply and cause its contractor to comply with all <br />Federal, State and Local laws, and all applicable ordinances and <br />regulations. <br /> <br />Section H. Right-of-Way, Easements and Permits <br /> <br />The City shall, without cost or expense to the State, obtain all <br />rights-of-way, easements, construction permits and/or any other <br />permits and sanctions'that may be required in connection with the <br />contract construction. Prior to advance payment by the State, the <br />City shall furnish the State with certified copies of the documents <br />for those rights-of-way, easements, construction permits and/or other <br />permits and sanctions required for State cost participation <br />construction covered under this Agreement. <br /> <br />The City will, require the property between the frontage road system <br />and Trunk Highway No. 10 through platting processes, have all access <br />control from the abutting properties along the south right-of-way <br />limits of Trunk Highway No. 10, from Joplin Street to Waco Street <br />dedicated to the State. The City will indemnify the State for any <br />and all costs or damages including attorney's fees, involving present <br />and/or future property owners seeking access to Trunk Highway No. 10 <br />from its southerly right-of-way within the limits described in this <br />paragraph. The access rights will be dedicated to the State through <br />the platting process prior to advance payment by the State. <br /> <br />Upon the City's receipt of a fully executed copy of this Agreement, <br />the City shall submit to the State's Utility Engineer an original <br />permit application for all City-owned utilities to be constructed <br />hereunder that are upon and within the trunk highway right-of-way. <br />Applications for permits shall be made on State form "Application For <br />Utility Permit On Trunk Highway Right-Of-Way" (Form TP2525). <br /> <br /> <br />
