80710 <br /> <br />WHEREAS the City is about to perform grading, surfacing, curb and <br />gutter, storm sewer, sediment ponds, concrete walk, lighting, <br />sanitary sewer and water main construction and other associated <br />construction upon, along and adjacent to Trunk Highway No. 10 from <br />Joplin Street to Waco Street, on Waco Street from Trunk Highway <br /> <br />No. 10 to 1,563 feet south of Trunk Highway No. 10 and on Business <br />'Center Drive (Trunk Highway No. 10 Frontage Road) from Joplin Street <br />to Waco Street within the corporate City limits in accordance with <br />City-prepared plans, specifications and/or special provisions <br />designated as State Project No. 7102-99 (T.H. 10=003)and State Aid <br />Projects No. 204-126-03 and No. 204-131-02; and <br /> <br />WHEREAS the City and State have agreed and the State is willing to <br />participate in the costs of grading, surfacing, curb and gutter, <br />concrete walk and trail construction and associated construction <br />engineering along Trunk Highway No. 10 and its frontage road system <br />consisting of BuSiness Center Drive and a portion of Waco Street as <br />hereinafter set forth; and <br /> <br />WHEREAS the State desires that the City create a controlled access <br />through platting along the Trunk Highway No. 10's south right-of-way <br />limits from Joplin Street to Waco Street and the City to indemnify <br />the State relating to said future rights-of-way access; and <br /> <br />WHEREAS Minnesota Statutes Section 161.20, subdivision 2 authorizes <br />the Commissioner of Transportation to make arrangements with and <br />cooperate with any governmental authority for the purposes of <br />constructing, maintaining and improving the trunk highway system. <br /> <br />IT IS, THEREFORE, MUTUALLY AGREED AS FOLLOWS: <br /> <br />ARTICLE I - CONSTRUCTION BY THE CITY <br /> <br />Section A.
