There are also 3 guyed lattice towers near the intersection of County Road <br /> 33 and Proctor Road and a lattice tower near the high school which do not meet setback <br /> requirements. The proposed tower and shelter do meet the setback requirements of the <br /> underlying R1c zoning district. <br /> 4. The special conditions and circumstances are not a consequence of the petitioner's own action or inaction. <br /> The circumstances that create the need for the variance are not a consequence of the <br /> petitioner's action or inaction. The circumstances are a result of the shape of the lot, <br /> location of the softball fields and the layout of the City Hall complex <br /> 5. The variance will not be injurious to or adversely affect the health, safety and welfare of the residents of <br /> the City or the neighborhood wherein the properly is situated and will be in keeping with the spirit and <br /> intent of this article. <br /> The variance will not be injurious to or adversely affect the health, safety and welfare of <br /> the residents of the City or the neighborhood wherein the property is situated and will be <br /> in keeping with the spirit and intent of this article.
