Memo to Board of Adjustments/V 03-05 <br /> October 28,2003 <br /> Page 2 <br /> 4111 Overview <br /> Existing Conditions <br /> The property is located just west of Lowell Avenue on the south side of Main Street.The <br /> property to the east is zoned C1 and is used as an office building,the properties to the south <br /> and west are zoned single family residential and are single family residences and the property <br /> to the north is zoned C2 and is used as offices. <br /> The property is 14,500 square feet in size. The existing building is currently being renovated <br /> for use as an office. Part of the renovation includes removing a deck on the rear of the <br /> house and replacing it with an addition.A portion of the existing building sits between the <br /> addition and the west property line.The existing building is setback.9 feet from the property <br /> line. The proposed addition will be setback 13.3 feet from the west property line. The <br /> required setback is 15 feet;the applicant is requesting a 2 foot variance. <br /> Analysis <br /> In order to grant a variance from the literal interpretation of the ordinance,the following <br /> five conditions must be met: <br /> 1. Literal enfo vement of the ordinance will cause undue hardship. <br /> • Literal enforcement would not allow the applicant to build the addition and provide <br /> needed interior space. The improvement is also needed to provide a rear entrance <br /> adjacent to and accessible from the rear parking area. <br /> 2. The hardship is causal by special conditions and circumstances,wt iah are peculiar to the property and <br /> the structure involvEd anchthzch are not characteristic of or applicable to,other lands or structure in the <br /> same area. <br /> The proposed addition is separated from the west property line by a portion of the <br /> existing building. Even though the improvement does not meet the required 15 foot <br /> setback,it is setback further than the existing building and behind the existing building. <br /> 3. The literal application of the provisions of this ordinance would deprive the petitioner of rights enjoyed by <br /> other properties in the same district under the terms of this ordinance. <br /> The adjacent commercial property has a rear entrance accessible from the rear parking <br /> lot.The variance will also allow the applicant to fill in or square off the back of the <br /> building, similar to the neighboring office building. <br /> 4.
