Appendix A: Resolution and Creating a Utilities Commission <br /> Trustee Ellingson presented the following resolution and moved its adoption: <br /> Resolution creating a Water, Light, Power and Building Commission in and for the Village of <br /> Elk River, Minnesota. <br /> Whereas, Chapter 412, Laws of Minnesota, 1907, and acts amendatory thereof, said chapter now <br /> being contained in Sections 1852 to 1860 both inclusive, of Mason's Minnesota Statutes, 1927, <br /> authorize the creation of a water, light,power and building commission, and <br /> Whereas, that law is applicable in the Village of Elk River and the Village of Elk River desires to <br /> adopt the provisions of that law, <br /> Now Therefore Be It Resolved, that a water, light, power and building commission is hereby <br /> created and established in and for the Village of Elk River, Minnesota, with all the powers and <br /> duties provided for in the aforesaid law; that said commission shall consist of three persons who <br /> are hereby appointed to be members of that commission for the terms set opposite their <br /> respective names, to wit: <br /> V. B. Skellinger For the term of one year <br /> Otis Nickerson For the term of two years <br /> C.F. Meyers For the term of three years <br /> This resolution shall become effective and the said commission shall be created as of the 11th <br /> day of July, 1947, and the terms of office of the said persons herein appointed shall begin as of <br /> that date and shall end on the last day of the calendar year in which their respective terms shall <br /> end,provided that these appointees and successive appointees shall hold their offices until their <br /> successors are appointed and qualified, and provided that appointments made of successors to the <br /> appointees at the expiration of their terms shall be for three years. Every commissioner hereby or <br /> hereinafter appointed under this resolution or by authority hereof, shall before entering upon the <br /> discharge of his duties take and subscribe to an oath that he will faithfully discharge the duties of <br /> the office to which he is appointed. <br /> This motion was seconded by Trustee Johnson and put to a vote. All members voted for it and it <br /> was thereby adopted. <br /> Adopted by the Council this 11th day of July 1947. <br /> Approved, G.B. Davidson, mayor <br /> Attest, H.A.
