THAT LITERAL ENFORCEMENT OF THE ORDANANCE WOULD CAUSE <br /> • UNDUE HARDSHIP. <br /> The reason for our request to build on to our garage is for extra storage space for,boat, <br /> motor home, trailer, snowmobile, four wheeler, etc. Currently those items are park either <br /> in the driveway or on the side of the existing garage, which makes our house and yard <br /> look junky. We are also storing some of the items, which become a costly issue. <br /> THAT THE HARDSHIP IS CAUSED BY SPECIAL CONDITIONS AND <br /> CIRCUMSTANCES WHICH ARE PECULIAR TO THE LAND AND THE <br /> STRUCTURE INVOLVED AND WHICH ARE NOT CHARACTERISTIC OF OR <br /> APPLICABLE TO OTHER LANDS OR STRUCTURES IN THE SAME <br /> DISTRICT. <br /> Because our lot has a pond, which is about 1/3 of our lot, which holds the main water <br /> runoff for the north end of the development the backyard is mostly covered with water so <br /> we can't build the garage there. If we were able to build back there we would be driving <br /> on our drainfield. Our drainfield goes out on to the north side of the lot. In order for the <br /> garage to be put there the garage would be on top of the drainfield, to comply with the 35 <br /> foot set back. Behind our garage we have trees, at the trees is a steep decline down to <br /> the pond. <br /> THAT THE LITERAL APPLICATION OF THE PROVISIONS OF THE <br /> ORDINANCE WOULD DEPRIVE THE APPLICANT OF RIGHTS ENJOYED BY <br /> OTHER PROPERTIES IN THE SAME DISTRICT UNDER THE TERMS OF <br /> THE ODINANCE. <br /> Again it comes back to the size of our lot and the amount of the lot that is covered by <br /> water. We would like to keep our development looking nice without clutter around <br /> people's houses. With the addition to the garage we can store more of our items in the <br /> garage and not out in the open. <br /> THAT THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE NOT A <br /> CONSEQUENCE OF THE PETIONER'S OWN ACTION OR INACTION. <br /> The special conditions are that we have a pond in our backyard that is 1/3 of our lot and <br /> the drainfield on the north side that goes almost over to the side property line which <br /> makes it impossible to drive around to the backyard. <br /> • <br />
