I do not think it appropriate for <br /> the City to attempt to legislate a fact that has no basis in reality. <br /> I therefore appeal the decision of the City of Elk River's Planner to not let me replace my <br /> existing garage facility. <br /> I appeal that decision, and <br /> in the alternative I seek a variance due to hardship, or <br /> in the alternative, I seek an appropriate amendment of the zoning ordinance changing the zone <br /> of my property or changing the zoning ordinance to permit the erection or replacement of <br /> garage facilities for nonconforming residential purposes. <br /> The erection of a garage facility will in no way extend the use of a nonconforming residential <br /> purpose. The use is, in fact, determined by the residential structure itself.
