Strikethroughs to be removed Underlines to be added Last Updated March 2014 Ordinance 15 - ____ An Ordinance Amending Certain Sections of Chapter 30 related to XCR extreme commercial recreation of the City of Elk River, Minnesota, City Code The City Council of the City of Elk River does hereby ordain as follows: SECTION 1. That § 30-1, Definitions of the City of Elk River Code of Ordinances shall be amended to read as follows: Active use storage means an enclosed facility containing multiple individual units used for the storage, maintenance, and display of vehicles. The facility may not be used for retail sales, business operations, or overnight stays. Campground means a facility used primarily for overnight and short-term tent camping in tents, truck campers and recreational camping vehicles. Campgrounds must comply with all State of Minnesota regulations regarding campgrounds and must be licensed with the Minnesota Department of Health as a Campground. Such a Camping vehicles shall meet the definition in state law for “Recreational Camping Vehicle”, and the following qualifications: (1) The vehicle is not used as the residence of the owner or occupant.; (2) The vehicle is used for temporary living quarters by the owner or occupant while engaged in recreational, vacation, or temporary vacation travel activities.; (3) The vehicle is towed or otherwise transported, by its own or by other power, on the public streets or highways incidental to such recreational or vacation activities. Permitted accessory uses include a recreational area for campground guests and retail sales of over- the-counter items for campground guests only. Limited stay lodging means a building or structure where sleeping, and cooking and/or sanitary facility accommodations are furnished to users for a period of no more than seven (7) consecutive days. Off-road racing means a format of racing where various classes of specially modified snowmobiles, cars, trucks, go-carts, and/or ATV’s compete in races on dirt or snow tracks. Parking, overflow event means temporary parking for a single event, on any surface, in non-designated parking areas that does not exceed 50% of the required parking for a business. Water sports facility means a facility where non-motorized water activities such as, but not limited to, wake boards, knee boards, and water skis, are powered by a secondary power source.
