<br />-thrd o-ui l-km S 9 <br />l(; f II{)~ <br /> <br />RESOLUTION NO, 04- 47 <br />A RESOLUTION OF THE CITY OF ELK RIVER, MINNESOTA <br /> <br />A RESOLUTION APPROVING ELK RIVER MUNICIPAL UTILITIES <br />BECOMING A MEMBER OF MIDWEST CONSORTIUM OF MUNICIPAL <br />UTILITIES <br /> <br />WHEREAS, Elk River Municipal Utilities desires to become a member of the <br />Midwest Consortium of Municipal Utilities, a Minnesota nonprofit corporation organized <br />under Minnesota Statutes Chapter 317 A, as authorized by Minnesota Statutes Section <br />452.25. <br /> <br />I' <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Elk River, a Minnesota municipal corporation, does hereby approve Elk River Municipal <br />Utilities becoming a member of Midwest Consortium of Municipal Utilities, a nonprofit <br />corporation organized under Minnesota Statutes Chapter 317 A, as authorized by <br />Minnesota Statutes Section 452.25; and <br /> <br />BE IT FURTHER RESOLVED, that the City Council of the City of Elk River, <br />does hereby ratify the participation of Elk River Municipal Utilities in a joint venture in <br />the form of a nonprofit corporation known as Midwest Consortium of Municipal Utilities, <br />as authorized by Minnesota Statutes Section 452.25; and <br /> <br />BE IT FURTHER RESOLVED, that the City Council of the City of Elk River, <br />does hereby approve the Articles of Incorporation of Midwest Consortium of Municipal <br />Utilities and does hereby approve the Bylaws of Midwest Consortium of Municipal <br />Utilities in the form attached to this Resolution. <br /> <br />Passed and adopted by the City Council at the City of Elk River this ih day of <br />June, 2004. <br /> <br />" <br /> <br />~.~ <br /> <br />Stephanie A.
