<br />An Ordinance Amending Sec-
<br />tions, 58-31, "Definitions," 58-34,
<br />"Recyclable materials," and
<br />58-37, "Containers" of the City of
<br />Elk River, Minnesota, City Code,
<br />to Implement the City Blue Bag
<br />Organics Solid Waste Program
<br />The City Council of the City of
<br />Elk River does hereby ordain as
<br />follows:
<br />SECTION 1_ That § 58-31, "Defi-
<br />nitions" of the City of Elk River Code
<br />of Ordinances shall be amended to
<br />add the following definition:
<br />"Slue Bag0(ganics Program"
<br />means the program used for SSO
<br />collection by means of iUj0g SSO
<br />into Blue Bag Organics bags.
<br />"Source Separated Organics
<br />(SSO)"means food scraps and
<br />soiled paper but not yard wastes
<br />or inorganic Mgterials such as re-
<br />cyclables and mixed municipal
<br />washes.
<br />SECTION 2. That, by revising
<br />Subsection (b), adding Subsection
<br />(c) and removing Subsection (d), §
<br />58-34, "Recyclable materials" of
<br />the City of Elk River Code of Ordi-
<br />nances shall be amended to read
<br />as follows:
<br />(b) Preparation for Recycling
<br />collection.

<br />ty to recycle afforded to occupants
<br />of other residential dwelling units.
<br />It is unlawful after January 1, 1992,
<br />for any multiple dwelling owner, as-
<br />sociation or joint management en-
<br />tity to negotiate, execute, or main-
<br />tain a contract for multiple dwelling
<br />garbage or other refuse collection
<br />unless it includes, as part of that
<br />contract or as part of a separate
<br />contract, a minimum of biweekly
<br />collection of recyclables or as
<br />deemed adequate by the city.
<br />SECTION 3. That § 58-37,
<br />"Containers" of the City of Elk
<br />River Code of Ordinances shall be
<br />amended to read as follows:
<br />(c) Recycling containers. The
<br />Hauler as contracted by the city
<br />shall provide to the owner or oc-
<br />cupant of each dwelling unit a
<br />container for the separation and
<br />collection of recyclable materials.
<br />The recycling containers will, at all
<br />times, remain the property of the
<br />eity-Hauler. The owner or occupant
<br />of each dwelling unit shall leave
<br />contact Elk River Municipal Utilities
<br />for collection of the recycling con-
<br />tainers at the premises upon relo-
<br />cation and shall maintain the recy-
<br />cling containers in good condition
<br />SECTION 4. That this ordinance
<br />shall take effect upon adoption and
<br />be published as provided by law.

<br />Council of the City of Elk River this
