(4) <br /> <br />(5) <br /> <br />(6) <br /> <br />(7) <br /> <br />(8) <br /> <br />(9) <br /> <br />(10) <br /> <br />No building, fence, wall, kennel, mailbox or other structure or other antennas shall be <br />commenced, erected or maintained upon any portion of the "Developer Property", nor <br />shall any exterior addition to or change or alteration therein be made or any grading or <br />landscaping be commenced until the plans and specifications showing the nature, kind, <br />shape, color, height, materials, and location of the same shall have been submitted to and <br />approval in writing as to harmony of external design and location in relation to <br />surrounding structures and topography by the Architectural Control Committee. In the <br />event the Architectural Control Committee, or its designated representative, fails to <br />approve or disapprove such design and location within thirty (30) days after said plans and <br />specifications have been submitted to it, approval will not be required and this provision <br />will be deemed to have been fully complied with. <br /> <br />No dwelling constructed on any portion of the "Developer Property" shall contain less <br />than 1,600 square feet of interior space on the ground floor in the case of a single story <br />structure, not less than 1,600 square feet of interior space on the first two levels at or <br />above the front entry elevation in the case of a split-level structure, and not less than 1,200 <br />square feet of interior space on the ground floor in the case of a structure containing two <br />or more stories, provided that the aggregate interior square footage for all levels is not less <br />than 1,750 square feet of interior space. Each Lot within the "Developer Property" shall <br />contain an attached garage sufficient to store a minimum of three (3) automobiles. <br /> <br />The main dwelling shall be completed within 12 months of commencement of <br />construction. <br /> <br />Siding on dwellings shall be earth tone colors of brick, stone, stucco, wood or steel. No <br />vinyl siding will be allowed. Siding materials other than those above specified may be <br />permitted with the written approval of the Architectural Control Committee. Shingles <br />shall reflect the style of the home. All roofs on main dwelling must have a roof pitch 6-12 <br />or more. All homes must have either a front porch or patio. <br /> <br />End load garages will be required for Lots that exceed 125 feet at setback and will not <br />disturb the natural contours of the site. Those lots are Lots 1, 2 and 7, Block 3, Lots 1, 2, <br />3, 6, 7 and 8, Block 2 and Lots 1 and 2, Block 1, Lots 2, 3, and 5 Block 4. <br /> <br />All grading, construction and related activities on any portion of the "Developer Property" <br />shall be conducted in accordance with the standards for such construction and the <br />requirements prescribed therefor by the City of Elk River, Minnesota. <br /> <br />No structure of a temporary character or nature, trailer, tent or shack may be used on any <br />Lot any time as a residence, either temporarily or permanently. <br /> <br /> <br />
