STATE OF MINNESOTA COUNT'( OF SHERBURNE CITY OF ELK RIVER CITY OF ELK RIVER CITY COUNCIL CONDITIONAL USE PROCEEDINGS In the matter of: Cargill Animal Nutrition Center Request: Conditional Use Permit for the following: (Case No. CU 95-05) -Existing and proposed feed lot operation -Improve existing operation by removing several outdated buildings and replacing them with six new fully-enclosed buildings -Produce approximately six hundred additional feeder pigs per year ORDER GRANTING CONDITIONAL USE Cargill, Incorporated, Owner The above entitled matter came to be heard before the City Council on the l Sth day of May, lC)95, on a petition for a Conditional Use pursuant to the City of Ell< River Zoning Ordinance, for the following described property: The East Half of the Northeast Quarter (E1/2 of NE1/4) lying North of the Point Douglas and Fort Ripley Military Road, all in Section Fourteen {14), Township Thirty-two (32), Range Twenty-six (26); and all of the North Half of the Northwest Quarter (N1/2 of NWl/4) of Section Thirteen {13), excepting the right-of-way of the St. Paul, Minneapolis and Manitoba Railway Company, and St. Paul and Northern Pacific Railway Company, in said Township Thirty-two (32), Range Twenty-six (26). Sherburne County, Minnesota IT IS ORDERED that a Conditional Use be granted as upon the following conditions or reasons: THAT THE APPLICANT MEET ALL OF THEIR REQUIREMENTS AS SET FORTH IN THE FEED LOT PERMIT FROM THE MINNESOTA POLLUTION CONTROL AGENCY. THAT TREES BE PLANTED ALONG 165TH AVENUE NEAR THE SECURITY FENCE TO ACT AS A VISUAL ENHANCEMENT TO THE FARM SITE. THAT THE NEWLY CONSTRUCTED BUILDINGS BE PAINTED TO MATCH THE EXISTING BUILDINGS.
