Further, Mr. Wells' operation is defined as a Public Nuisance under the following Section: <br />Sec. 46-36. - Excessive noise. <br />It is declared to be a public nuisance for any person to make or assist in the making of any <br />nuisance noise or any loud, unnecessary or unusual sound or any sound which annoys, <br />disturbs or affects the comfort, repose, health, peace, or safety of others in the city. <br />Specifically under Section: <br />46-37. --Specific noises prohibited. <br />(6) Vehicle loading and exhausts. The discharge of the exhaust of any motor vehicle into the <br />ambient air except through a muffler which is free of holes, cracks, or other defects, or the <br />operation, loading, or unloading of any motor vehicle in such manner as to create loud and <br />unnecessary grading, grinding, rattling, or other noise which shall disturb the comfort or repose <br />of any persons in the vicinity. <br />Lastly, Mr. Wells' operation is in violation of Sec. 30-962. — Noise, by exceeding the decibel levels <br />set forth in Table ##1 of that section. <br />Mr. Wells has shown an indifference to repeated phone calls from neighbors asking hire to comply <br />with his permit. When he does comply, the noise levels are tolerable. Our fear is he will go back <br />to ignoring the conditions he agreed to operate under, once the city pressure is off of him. If he is <br />given another chance to comply, make it his last with immediate revocation of his permit for the <br />next violation. <br />
