Downtown Revitalization Project Update <br /> August 25,2003 HRA Meeting <br /> Page2of5 <br /> Property Title <br /> Q What is the status of the deed restriction on the City-owned Jackson Square property? <br /> A. The Village of Elk River acquired the Jackson Square parking lot property on <br /> October 10, 1958. The property was deeded to the Village of Elk River by Quit <br /> Claim Deeds from Emil and Edith Parent, and The Standard Oil Company. Both <br /> conveyances were made with a condition regarding the use of the property for public <br /> purposes. City Attorney,Peter Beck has reviewed the deeds and has advised staff <br /> that the use limitation has lapsed under appropriate statutes of limitation. The <br /> limitation on use,restricting the City to utilize the property for public purposes, is no <br /> longer enforceable under Minn. Stat 500.20, and no notice by the previous owners or <br /> heirs have been filed to extend the effect of the use limitation. A title commitment <br /> has been ordered. <br /> Parking Options <br /> Q What are the current time limits on parking in Dozentazen? When was the last coordinated <br /> ezforzenezt of the restrictions? <br /> A. There is a 3-hour time limit on Main Street,Jackson Avenue, King Avenue, and the <br /> Jackson Square parking lot. There is a 4-hour time limit on the parking lot to the <br /> rear of Kemper Drug. The last coordinated enforcement was early 1998. <br /> Enforcement was stopped at the request of the business owners who felt customers <br /> • were being tagged unnecessarily. <br /> Q How many temporary parking stalls could be constructed in the green space haulm the Cinema <br /> Building and the Sunshine Depot? <br /> A. The attached illustration of additional temporary parking indicates six stalls could be <br /> constructed immediately adjacent to Main Street. Eight additional stalls could be <br /> constructed below the hill. <br /> Q Can diagonal parking be added to the north side of Main Street and/or the east side of Jackson <br /> Avenue? <br /> A: Main Street and Jackson Avenue are both Municipal State Aid routes in the City of <br /> Elk River. As such,the design of the streets is in accordance with State Aid design <br /> criteria. There is not sufficient width on either of the streets to allow diagonal <br /> parking on the opposite sides. The design standards require additional street width <br /> when diagonal parking is in place to allow for backing movements to begin. This <br /> enables a parked vehicle to start backing out of the stall and to observe whether or <br /> not there is an opportunity to complete the movement,while at the same time <br /> maintaining traffic flow on the street. <br /> Q Could diagonal parking he added to the north side of Main Street and east side of Jackson Avenue <br /> if the Municipal State Aid Designation were removed? <br /> 111111 A: Substantial Municipal State Aid dollars have been spent on both Main Street and <br /> Jackson Avenue over the last 15 to 20 years.
