Street Vacz6on <br />In reviewing your request, staff has learned that the street infrastructure located in Natures Edge <br />Business Center received funding from the Greater Minnesota Business Development Public <br />Infrastructure Program. <br />The restricted property is bond finance property and cannot be sold, mortgaged, encumbered or <br />otherwise disposed of without the approval of the Commissioner of Minnesota Management and <br />Budget. Their approval is likely not to happen. <br />Because state funding was used for the public improvements, any required reimbursements are the <br />responsibility of the applicant. <br />An alternative is the City Council can direct staff to work with you on a Licenses Agreement for the <br />street. The city has utilized this in the past. You virtually have use of the property as you need to <br />and accept the ongoing maintenance of the street while the city maintains ownership. <br />Staff will continue to review all three applications as if the street is not vacated and a Licenses <br />Agreement is not granted. <br />Please let me know if you want to continue with the Street Vacation or if you want to withdraw that <br />application and explore the Licenses Agreement by April 22, 2015. <br />Zone Change <br />Staff conducted a thorough review and main issue is that in staffs opinion, the use is not consistent <br />with the Comprehensive Plan and the Focused Area Study. <br />However, the city will initiate a Land Use Amendment on your behalf that would be reviewed by the <br />Planning Commission on May 26, 2015 and then the City Council on June 1, 2015. <br />In order for city staff to review your request prior to the Planning Commission, please submit revised <br />drawings and other requested information, as indicated above, by April 22, 2015.
