Planning Commission/V 97-14 <br /> September 30, 1997 <br /> Page 2 <br /> • request is to legitimize an existing condition and to allow the church to <br /> expand their building and parking lot to be improved under its current <br /> conditions. <br /> Recommendation <br /> It is recommended the Board of Adjustments approve the variance request by <br /> Central Lutheran Church to allow a 7 foot variance to the 10 foot parking <br /> setback requirement along the south property line, based on the following <br /> findings: <br /> 1. THE LITERAL ENFORCEMENT OF THE ORDINANCE WOULD CAUSE AN UNDUE <br /> HARDSHIP UPON THE CHURCH BY REQUIRING THEIR PARKING AREA AND BUILDING <br /> PLANS TO BE ADJUSTED. <br /> 2. THE HARDSHIP CAUSED BY THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE <br /> PECULIAR TO PIECES OF PROPERTY WHICH MAY HAVE BEEN DEVELOPED UNDER <br /> PREVIOUS CODES AND ORDINANCES AND NOW ARE TRYING TO MEET THE INTENT OF <br /> THE ORDINANCE. <br /> 3. THE LITERAL APPLICATION OF THE PROVISIONS OF THIS ORDINANCE WOULD DEPRIVE <br /> THE CHURCH OF THE RIGHTS ENJOYED BY OTHER EXISTING FACILITIES THAT HAVE <br /> EXPANDED AND REQUIRED VARIANCES. <br /> • 4. THE SPECIAL CONDITIONS AND CIRCUMSTANCES ARE NOT A CONSEQUENCE OF THE <br /> PETITIONER'S OWN ACTION. <br /> 5.
