Memo to Board of Adjustments/V 97-12 <br /> September 30, 1997 <br /> Page 2 <br /> *The applicant also needs a variance to the parking setback for his existing <br /> parking areas along Highway 10 and Lowell already at variance to the <br /> required setback. <br /> Variance Requirements <br /> Staff refers the Board to Section 900.40 of the City of Elk River code of <br /> ordinance for the five standards to consider when reviewing a variance. <br /> Recommendation <br /> If the Board decides to grant this variance request, the following findings are <br /> offered in support of that determination: <br /> 1. Literal enforcement would cause undue hardship in that the applicant <br /> would not be able to make the improvements requested by Texaco <br /> thereby presumably damaging relations. <br /> 2. The hardship is caused by special conditions peculiar to this lot such as <br /> size and shape, and orientation to the highway. <br /> • 3. The variance will not be injurious to or adversely affect the health, <br /> safety or welfare of the residents of the city or the neighborhood, as the <br /> fuel pumps already exist in the present location as does the building <br /> and parking lots.
