The statute provides that no such improvements <br /> shall be made or the special assessments adopted until the <br /> 110 Council shall have held a public hearing on such improvements <br /> and special assessments following mailed notice and publication <br /> thereof in the official newspaper stating time and place of the <br /> hearing, the general nature of the improvement, the estimated <br /> costs thereof, and the area proposed to be assessed and that <br /> the proposed assessment roll is on file with the Clerk, in <br /> accordance with law. <br /> NOW THEREFORE, BE IT RESOLVED by the City Council of the <br /> City of Elk River, Minnesota, as follows: <br /> 1. A public hearing will be held at the time and place <br /> set forth in the Notice of Hearing hereto attached to consider <br /> said proposed improvements and special assessments. <br /> 2. The notice of said public hearing shall be in <br /> substantially the form contained in the notice hereto attached. <br /> 3. The notice shall be published by the Clerk in the <br /> official newspaper twice, the first publication at least two <br /> weeks prior to the hearing and the second publication a week <br /> later but at least three days shall elapse from the second <br /> publication to the date of the public hearing and the notice <br /> shall be mailed to the owners of each parcel described in the <br /> assessment roll at least two weeks prior to the hearing. <br /> • - The motion for the adoption of the foregoing resolution <br /> was duly seconded by member and upon <br /> a vote being taken thereon, the following voted in favor <br /> thereof: <br /> and the following voted against the same: <br /> Whereupon said resolution was declared duly passed and <br /> adopted. <br /> III <br />
