STATE OF MINNESOTA <br /> CITY OF ELK RIVER <br /> COUNTY OF SHERBURNE RESOLUTION 81-42 <br /> RESOLUTION OF CITY COUNCIL VACATING STREET <br /> In the Matter of the Vacation of that part of Freeport Avenue (formerly <br /> Summer Street) lying South of the South line of Third Street and lying North <br /> of the North line of Main Street in the City of Elk River. <br /> The above entitled matter came on to be heard before the City Council <br /> of the City of Elk River, Sherburne County, Minnesota, upon the Petition <br /> of Eugene N. Kreuser and upon Motion of the City Council for the vacating <br /> of the said portion of Freeport Avenue, above described; and the City Council <br /> having given due notice of said hearing by published and posted notice as <br /> provided by law and said hearing having been held on the 5th day of October <br /> 1981, at 8:00 o'clock p.m. at the Elk River Public Library <br /> in said City, and no one appearing in opposition thereto and the said Council <br /> after hearing the evidence presented it in favor of said Petition finds: <br /> 101, That said protion of Freeport Avenue is not serving any public purpose and <br /> it would be in the best interest of the public to vacate said portion of <br /> Freeport Avenue; <br /> Councilman Duitsman introduced the following resolution, to-wit: <br /> That all that part of Freeport Avenue (formerly Summer Street)lying <br /> South of the South line of Third Street and lying North of the North line <br /> of Main Street in the City of Elk River, be and the same hereby is vacated. <br /> Which resolution was seconded by Councilman Engstrom, and <br /> being put to a vote was passed by a unanimous vote in favor of said <br /> resolution by all members of the City Council whereupon said resolution was <br /> declared adopted by the Mayor of said City. <br /> Dated at the City of Elk River, <br /> This 5th day of October , 1981. <br /> -4:1/ <br /> Mayor <br /> Attest: <br /> Clerk <br /> STATE OF MINNESOTA <br /> COUNTY OF SHERBURNE <br /> Robert Middaugh being first duly sworn says that he is the duly appointed <br /> and acting City Clerk of the City of Elk River, Sherburne County, Minnesota, <br /> and as custodian of said resolutions and minutes of said City Council of <br /> said City, for the regular meeting held thereof on October 5, 1981 • <br /> AUDITOR'S' :,➢:r c Robert iddaugh / <br /> T ,_1 <br /> OCT 8 1981 <br /> § y� <br /> �,..
