We feel the proposed design of the house follows the intent of the City's Comprehensive <br />Plan. The Comprehensive Plan regulates our property as residential, where garages are <br />allowed. <br />Variances may be granted when the petitioner establishes that there are practical difficulties in complying <br />with the zoning ordinance. Practical difficulties means that: <br />3. The petitioner proposes to use the property in a reasonable manner not permitted by the -oning ordinance; <br />The use of the property is in a reasonable manner. We feel that building a garage is using our <br />property in a reasonable manner. We are only asking that a small portion of the garage <br />(northeast corner) be in the setback to preserve two trees. <br />4. The p light of the petitioner is due to circumstances unique to the property not a consequence of the petition's <br />own action or inaction; and <br />We feel our property has unique environmental characteristics. Much of the 2.7 acres we <br />have is wetland and the land slopes heavily downward on the west and south sides. The most <br />buildable area on the property is on the east side of the lot behind our house where we are <br />proposing it. The closer we can build to our east lot line, the less disruption we will have to <br />our outdoor environment and two trees we want to keep. <br />5. The variance, ifgranted, will not alter the essential character of the locality. <br />The essential character of the locality will not be altered. Due to the secluded wooded nature <br />of the properties in the area, the garage won't be seen. The only public that would be <br />affected would be our neighbors to the east and they have no objections to the variance. <br />They certainly could move someday but the new owners would be aware of the garage. <br />Analysis <br />Comprehensive Plan <br />The Comprehensive Plan has been established through the development of the area for single family <br />residential.
