CITY OF BIG LAKE <br /> ORDINANCE NO. 2 <br /> An Ordinance Permitting the Placement of Temporary Docks Adjacent <br /> to the Shore of Big Lake on Certain Designated Public Rights-of-Way <br /> 1. The temporary placement of docks shall be permitted from specified <br /> areas of public property and/or public rights-of-way adjacent to <br /> the shores of Big Lake and Mitchell Lake in the following <br /> described area: <br /> All that part of Shadywood Park according to the recorded plat <br /> thereof, Sherburne County, Minnesota lying Easterly of a line <br /> distant 66.00 feet East of the Easterly lines of Blocks 1, 2, 3, 4 <br /> and 5 and there Northerly and Southerly extensions <br /> and <br /> All that part of Oakland Heights according to the recorded plat <br /> thereof, Sherburne County, Minnesota lying Easterly of a line <br /> distant 66.00 feet East of the Easterly lines of Blocks 1,2 and 3, <br /> and there Northerly and Southerly extensions. <br /> 2. All docks shall be marked with the owner's name and address in a <br /> conspicuous place clearly visible to the public. <br /> 3. All docks, boat lifts and all other personal property must be <br /> removed from Big Lake and Mitchell Lake and the public <br /> right-of-way as hereinabove described between November 15 and <br /> • April 1 of each calendar year. <br /> 4. A violation of a provision of this Ordinance is a misdemeanor. <br /> 5. Notwithstanding any other penalties described herein, in the event <br /> a party fails and/or refuses to remove' a dock or other personal <br /> property from the lake or public right-of-way, then upon failure <br /> to comply following written notice tb the owner as identified in <br /> accordance with Paragraph 2, the City of Big Lake shall be <br /> entitled to remove said offending property, storing and selling <br /> the same in accordance with offending property, storing and <br /> selling the same in accordance with Minnesota Statutes. In the <br /> event the City of Big Lake suffers a cost of storage and/or sale <br /> which is not recovered from the sale, the City of Big Lake shall <br /> be entitled to maintain a cause of action against the owner of the <br /> dock and/or property to recover the remaining balance. <br /> 6.
