there is deemed the act of the licensee as well, and the licensee <br /> shall be liable for all penalties provided by this ordinance and <br /> the law equally with the employee. <br /> 3. Inspections. The licensee shall allow any peace officer, <br /> health officer , or properly designated officer or employee of the <br /> City to enter , inspect, and search the premises of the licensee <br /> during business hours without a warrant. <br /> 4 . Display During Prohibited Hours. No on-sale establishment <br /> shall display liquor to the public during hours when the sale of <br /> liquor is prohibited. <br /> 5 . Federal Stamps. No licensee shall possess a federal whole- <br /> sale liquor dealer 's special tax stamp or federal gambling stamp. <br /> 802.16 - Restrictions on Purchase and Consumption. <br /> 1. Liquor in Unlicensed Places. No person shall mix or prepare <br /> liquor for consumption in any public place or place of business <br /> unless it has a license to sell liquor on-sale or a permit from <br /> the Commissioner of Public Safety under Minnesota Statutes, <br /> Section 340.119 , and no person shall consume liquor in any such <br /> place. <br /> 2. Consumption in Public Places. No person shall consume <br /> liquor on a public highway or in a public park or other public <br /> place. <br /> 802. 18 - Suspension and Revocation. The Council may suspend for <br /> not to exceed sixty (60) days or revoke any liquor license upon a <br /> finding that the licensee has failed to comply with any applicable <br /> statute, regulation or ordinance relating to intoxicating liquor . No <br /> suspension or revocation shall take effect until the licensee has been <br /> afforded an opportunity for a hearing pursuant to Minnesota Statutes , <br /> Sections 15.0418 to 15.0426. <br /> Section 804 - Establishing and Regulating the Operation of a Municipal <br /> Liquor Dispensary <br /> 804.00 - Definitions. Unless the context clearly indicates other- <br /> wise, the words, combinations of words, terms or phrases as used in <br /> Section 804 .00 et seq. shall have the meanings set forth in the <br /> following paragraphs: <br /> 1 . "Intoxicating liquor" and "liquor" shall mean ethyl alcohol , <br /> distilled, fermented, spiritous, vinous and malt beverages <br /> containing more than three and two-tenths percent ( 3 . 2% ) alcohol <br /> by weight. <br /> 2 . "Beer" shall mean any malt beverage with an alcoholic <br /> content of more than one-half of one percent (1/2 of 1% ) by volume <br /> and not more than three and two-tenths percent ( 3.2%) by weight. <br /> 160. <br />
