M <br /> RESOLUTION 79-42 <br /> • RESOLUTION AUTHORIZING SUBMISSION OF <br /> A LAND USE PLANNING GRANT APPLICATION <br /> WHEREAS, the City of Elk River, a predominantly rural community situated just <br /> outside the boundaries of a concentrated urban area, finds that certain <br /> parts of its existing plans and official controls are inadequate for <br /> the regulation and control of development within its jurisdiction; and <br /> WHEREAS, the City of Elk River is traversed by major corridors, U.S. Highways <br /> 10, 52 and 169. In addition, Minnesota trunk Highway 101 crosses the <br /> Mississippi to intersect Interstate Highway 94. These highways pro- <br /> vide good access to the Twin Cities metropolitan area and to the St. <br /> Cloud metropolitan area. This impacts the City by causing urban resi- <br /> dential and commercial development in the area which will continue at <br /> an increasing rate; and <br /> WHEREAS, consolidation of the former Township of Elk River and the former City <br /> of Elk River into a new City of Elk River has recently taken place by <br /> order of the Minnesota Municipal Board, dated October 31 , 1977; and <br /> WHEREAS, this consolidation has created a dual system of regulatory controls <br /> inadequate to regulate the growth of the City of Elk River as newly <br /> created; and <br /> • WHEREAS, the former City of Elk River contains a central business district and <br /> land use for residential , commercial , industrial , institutional and <br /> public purposes. The former Township of Elk River contains land use <br /> for commercial purposes, particularly along U.S. Highways 10, 52, 101 <br /> and 169, and land use for urban, residential and agricultural purposes; <br /> and <br /> WHEREAS, existing zoning in the former Township immediately adjoining the former <br /> City of Elk River must be changed to reflect possible urban densities <br /> and urban streets and utilities; and <br /> WHEREAS, urban development at high densities, with on-site sewage disposal sys- <br /> tems, which is presently permitted, presents a potential problem of <br /> ground water pollution, and hence pollution of drinking water; and <br /> WHEREAS, the subdivision of land in areas lying outside of the boundaries of <br /> the former City of Elk River by way of metes and bounds legal des- <br /> criptions, private streets or streets not accepted for maintenance <br /> by the City has created and continues to create growth management and <br /> record-keeping difficulties for the City of Elk River; and <br /> WHEREAS, requirements imposed by the Municipal Planning Act, the designation of <br /> the Mississippi River as being subject to wild and scenic rivers regu- <br /> lation and the desire of the City of Elk River to accomodate growth <br /> in a rational and efficient manner require that the City Council pre- <br /> pare and recommend for hearing and adoption amendments to its compre- <br /> hensive plan and ordinances, regulations and progrmas governing the <br /> land use and development within the City of Elk River; and <br />
