111 <br /> RESOLUTION NO. 79-35 <br /> RESOLUTION ORDERING THE CONSTRUCTION OF <br /> A RAIL CROSSING IMPROVEMENT TO SERVE THAT AREA <br /> KNOWN AS THE PETERSON ADDITION AND AUTHORIZING <br /> THE MAYOR AND CITY ADMINISTRATOR TO ENTER INTO <br /> A CONTRACTUAL AGREEMENT WITH THE BURLINGTON NORTHERN <br /> RAILROAD TO ACCOMPLISH SAID CONSTRUCTION <br /> WHEREAS, a public hearing was conducted on August 20, 1979 at the Elk <br /> River City Council meeting; and, <br /> WHEREAS, a legal notice of the public hearing was published in the offi- <br /> cial City newspaper and affected property owners were given ten <br /> days mailed notice; and, <br /> WHEREAS, the Burlington Northern Railroad is the only agency which con- <br /> structs public rail crossings; and, <br /> WHEREAS, the City of Elk River has received and reviewed a contractual <br /> agreement between the Burlington Northern Railroad and the City <br /> of Elk River for the installation of a railroad crossing to ser- <br /> vice the Peterson Addition. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River <br /> • that construction of a public rail crossing to service the Peterson <br /> Addition is hereby ordered and approved and that the Mayor and City <br /> Administrator are hereby authorized to enter into a contractual <br /> agreement with the Burlington Northern Railroad for the construction <br /> of the public rail crossing to service the Peterson Addition. <br /> Adopted this 20th day of August, 1979, by the City Council of the City of <br /> Elk River. <br /> air <br /> Frank in Madsen, Mayor <br /> ATTEST: <br /> Robert C.
