15. A TREE PRESERVATION PLAN BE APPROVED PRIOR TO RELEASING THE PLAT FOR <br /> RECORDING. <br /> <br />18. <br /> <br />ANY TREES OFF SITE OR ON SITE, NEAR THE LIMIT OF GRADING THAT ARE TO BE <br />PRESERVED, SHALL BE FENCED WITH A SNOW FENCE AT THE DRIP LINE TO PREVENT <br />GRADING, COMPACTION, OR STORAGE OF EQUIPMENT, DEBRIS OR MATERIALS. <br />STAFF SHALL INSPECT FENCING PRIOR TO GRADING COMMENCING. <br /> <br />19. ALL COMMENTS CONTAINED IN REBECCA HAUG'S MEMO DATED 5/12/04 SHALL BE <br /> ADDRESSED. <br /> <br />Should the Council deny the preliminary plat, the Council should consider basing that <br />decision of the following findings: <br /> <br />The physical characteristics of the site, including but not limited to <br />topography, soils, vegetation, susceptibility to erosion and siltation, <br />susceptibility to flooding, and drainage are not suitable for the type and <br />density of development and uses contemplated. <br /> <br />This area has been identified on the Minnesota County Biological Survey <br />Map of Sherburne County as one of the last remaining mature samples of <br />deciduous dry oak forests in Elk River. Because of the amount of grading <br />required and the large number of mature trees that will be removed, the <br />proposed subdivision will cause substantial environmental damage <br /> <br />An option the Council could consider should the plat be denied is to ask the applicant to <br />come back with a plat with the same number of lots but clustered on the west side of the <br />plat. This would require substantial reduction in lot area and lot width or the use of <br />townhouses. <br /> <br /> <br />
