<br />CITY COUNCIL <br />CITY OF ELK RIVER <br />ORDINANCE NO. 15-____ <br />AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING THE CITY <br />CODE PROVISIONS GOVERNING STORMWATER MANAGEMENT <br />The City Council of the City of Elk River does hereby ordain as follows: <br />Section 1. That Chapter 30, Article VII, including Sections 30-2172 through 30-2176, of the <br />Sec. <br />City of Elk River Code of Ordinances, shall be repealed. <br />Section 2. That Chapter 78, Article V, of the City of Elk River Code of Ordinances, shall be <br />amended to add Division 3, governing stormwater management, which shall read as follows: <br />Division 3. STORMWATER MANAGEMENT <br />Sec. 78-501. - Generally. <br />(a) set <br /> <br />a.The purpose of this article is to satisfy SWPPP obligations for a regulatory mechanism to <br />control stormwater pollution and illegal discharges under the statewide general permit for small <br />MS4s. This article sets forth minimum requirements for stormwater management to diminish <br />threats to public health, safety, public and private property and natural resources of the <br />community by establishing standards that will: <br />(1) <br /> <br />1.Protect life and property from dangers associated with flooding; <br />(2) <br /> <br />2.Protect public and private property from damage resulting from runoff or erosion; <br />(3) <br /> <br />3.Ensure site design minimizes the generation of stormwater and maximizes pervious <br />areas for stormwater treatment; <br />(4) <br /> <br />4.Promote regional stormwater management by watershed; <br />(5) <br /> <br />5.Protect, maintain and/or restore water quality from nutrients, pathogens, toxics and <br />debris; <br />(6) <br /> <br />6.Promote infiltration and groundwater recharge; <br />(7) Achieve a 60 percent reduction in phosphorus load rates to waters compared to no <br />controls for all new development, and a mean of 40 percent reduction in phosphorus load <br />for redevelopment areas that do not currently meet the 60 percent reduction standard and <br />for street reconstruction where practicable. <br />(b) <br /> <br />7.Promote water quality treatment for new development, redevelopment, and linear <br />construction projects. <br /> <br />b.No person shall develop any land for residential, commercial, industrial, or institutional uses <br />without having provided the stormwater management measures set forth herein to control or <br />manage runoff from such development. All water entering the storm drain system generated on <br />any developed and undeveloped lands, unless explicitly exempted by the city, shall be protected <br /> <br />
