If a motion to approve is <br />made, staff recommends the following conditions: <br />1. As a CUP is not a Building Permit, the applicant shall apply for all required permits. <br />2. Fitness /martial arts class sizes shall not exceed 80 students. <br />Background /Discussion <br />Case No. CU 15 -04 <br />Adam Ahern, owner of Academy Elk River, is requesting a CUP to locate a commercial recreational <br />facility in the I -1 (Light Industrial) district. A CUP is required because, in the past, the City Council was <br />concerned with the loss of industrial space. <br />The Academy Elk River has been open since April of 2012 and offers martial arts programs for people of <br />all ages and abilities.
