ity of <br /> <br />River <br /> <br />Item #4.12. <br /> <br />MEMORANDUM <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />Mayor & City Council <br />Pat Klaers, City Adm~ <br />December 21, 1998 <br /> <br />SUBJECT: <br /> <br />Initiating Eminent Domain Process for <br />Easement and Right-of-way Acquisition <br />East Elk River Project <br /> <br />City Attorney Peter Beck is working with staff in putting together resolutions <br />which, ff approved by the City Council, would begin the eminent domain <br />process for the necessary fight-of-way and easements for the street and <br />utility project in the east Elk River. We will be having the Council consider <br />action for all the necessary property, excluding any properW which may be <br />acquired with federal funds (Brown, Eull, Korthals, and Barrett). The <br />resolutions will also include the developer property which we fully expect to <br />be given to the city through the platting process. <br /> <br />After action by the City Council on the resolutions, a certain amount of time <br />and work is required before the documents will be ready to be served and <br />filed at district court. This serving and filing begins the 90 day "quick take" <br /> <br />process. <br /> <br />According to the city engineer, the minimum that is required in order for the <br />sewer and water project to begin is the easements and right-of-way from the <br />two developers, and again, we expect this to be provided to the city without <br />having to condemn. The other right-of-way and easements are needed by <br />late spring/early summer. Nonetheless, we are preparing for a worse case <br />scenario in terms of the bids being approved and trying to ehminate any <br />delay in having the necessary easements and right-of-way for the project to <br />get underway and continue without interruption. The timing of the filing of <br />the other documents will depend on the status of negotiations between the <br />city and the property owners. <br /> <br />At the time of the writing of this memo it is uncertain ff any material will be <br />attached. If the resolutions are available they will be included, otherwise <br />they are planned to be presented at the City Council meeting.
