Background /Discussion <br />The applicant is proposing to re -plat 64 four and six -unit townhomes in the West Oaks Subdivision as 44 <br />single - family detached townhome lots. The new development is currently named West Oaks PUD. This <br />proposal is similar to the Kliever Lakes Fields 4"' and 5"' Additions approved in 2013 and 2014 where <br />existing townhome lots were re- plated to single - family lots. The R3 zoning district standards will be used <br />as a starting point for developing the PUD agreement. <br />To construct the project, four applications require City Council approval and include a request to change <br />the zoning from R3 Townhouse /Multiple Family Residential to PUD, a CUP to establish a PUD district, <br />and a Preliminary and Final Plat. <br />Planning Commission <br />The Planning Commission did not have any concerns but added additional landscape screening <br />requirements due to testimony received during the public hearing. The commission recommended <br />approval of the Zone Change, Preliminary Plat, and Conditional Use Permit 4 -0. <br />Public Hearing <br />During the public hearing three property owners expressed opposition to the project. Two residents of <br />the north most townhome are concerned about the proximity of the proposed home to their building. <br />The current proposal identifies 22 feet between the two buildings, which is a reduction from the current <br />25 -foot setback. This reduced space between buildings is possible because the proposed property line <br />setback is being reduced to five feet along the side property lines. To address the concern, the Planning <br />Commission added a condition for a mixed vegetative screen between the buildings. The residents and <br />the developer found this agreeable. <br />The neighbor to the west of the plat in Big Lake Township is concerned about the density of the <br />development. Staff explained that the proposal reduces the overall density from what is currently <br />approved for permitting. <br />Easement Vacation <br />The applicant has pulled his application to vacate a portion of the utility easement on an existing duplex <br />lot.
