ORDINANCE 04- 07 <br />CITY OF ELK RIVER <br /> <br /> AN ORDINANCE AMENDING THE <br />CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTIES <br />FROM RI C (SINGLE FAMILY RESIDENTIAL) TO PUD (PLANNED UNIT <br />DEVELOPMENT) <br /> <br />CASE NO. ZC 04-02 <br /> <br />The City Council of the City of Elk River does hereby ordain as follows: <br /> <br />Section 1. The duly adopted Zoning Map of the City of Elk River is hereby amended to <br />rezone the properties described as: <br /> <br />Outlot A, Hillside Estates l0th Addition <br /> <br />Section 2. The rezoning is being approved based on the following findings: <br /> <br />1. The proposed rezoning to PUD is consistent the land use designation of <br /> Highway Business. <br /> <br />2. The design of the PUD, as well as the vegetation to be preserved and <br /> proposed screening, will reduce the impact on neighboring residences. <br /> <br />The rezoning will reduced the amount of traffic on Dodge Street. The nine <br />residences that would be located on Dodge Street will not be constructed, <br />therefore, the associated traffic generated by those residences will not occur. <br /> <br />Section 3.
