Plannitig Con-imission Nftautts <br />Novembet 5, 2014 <br />Pap-- 2 <br />4.2 Request by City of Elk River for Ordinance Amendment to Section 30 of the <br />C'ity of Elk River Elk River L,and Use Regulations to add Focused Area Study <br />Business District, Case NoA 14-07 — Public Hearing <br />The staff report was presented by.,leremy Barnhart. lie stated that the amendment will <br />create a new district, and rezoning of the properties is a separate issue., He explained that the <br />Southern Twin Lakes Road Business District is a unique zoning district, with sub districts. <br />He noted that truck sales and service ordinance amendment which was just approved will be <br />added. <br />Mr. Leeseberg reviewed the spreadsheet, listing uses in the city's current zoning districts and <br />the proposed uses for the sub zones. <br />Discussion then followed regarding the uses in. the matrix where there was a discrepancy <br />between staff and the Plannitig Commission on classification of a particular use (i.e., <br />Per pitted, Conditional or not allowed). <br />Chai.rJohnson opened the public hearing <br />Steve Rolilf, 12821 188'r'Avenue NW, representing Cornerstone Auto, asked if their new <br />I.-'-i.q Auto will be rezoned to the I firige subzone by this action. MT. Barnhart explalined that <br />the ordinance amendment creates the district and rezoning will be a separate action, tying <br />parcels to a particular zoning. lie stated lie anticipates rezonings will be done at the <br />December planning Corriniission mecfing. Mr. Ro,hlf submitted a written objection to the <br />elimination of auto, sales as a Conditional LJse in the Hinge zoning area. Mr. Barnhart noted <br />that staff will not be teconimending that existing PUD's be rezoned. Mr. Rohlf asked if <br />there would be individual notices sent for the rezonings. Mr. Barnhart stated no, Mr, Rohlf <br />stated asked if it is being recommended that auto sales are a Conditional Use in the Hinge. <br />Mr. Barnhart stated yes. Mr. RohIf state that was a welcome change from last month's <br />meeting. He stated that they, would not have been able to, get a dealership license for the Kia <br />site if it became a nonconforming use. <br />John Winston, 815 Wayzata Blvd, Wayzata, NI Vit, representing Scott Powell/Cornerstone <br />Auto — stated that this is a massive zoning project and it has been a huge concern what the <br />inipact would be on auto sales in the Hinge. fie stated that with the change frons not being <br />allowed to being allowed as a Conditional t3se, would have a big impact on. possible <br />expansion in the futare. Mr. Winston stated that he has had dialog with the city's attorney, <br />Peter Beck, regarding Lot 4, Block 1, Mississippi I�dge Second Addition, and they are <br />optirnistic their issues can be resolved, <br />Confunissioner Konietzko asked what the he prop,ertyi owner's intent was for Lot 4, Block 1. <br />Mr. Winston stated that it has always been a commercial site and the agreements with the <br />city reflect that designation. Fie stated that dowrizoning the property to residential would <br />have a serious impact on the property value, and sibmificant expenditures have been incurred <br />for the property to be commercial (sewer and water, taxes, etc.), He stated that a street is <br />now proposed to run through it. Mn Winston agairistated lie anticipates a satisfactory <br />resolution. <br />
