City of <br /> Elk <br /> River <br /> Resolution 14- <br /> A Resolution of the City of Elk River Amending Agreement 14-07 between <br /> the City of Elk River and the Tri-County Action Program, Inc. <br /> WHEREAS, this Amendment is entered into on the 1"day of December, 2014, by and <br /> between the City of Elk River ("Lessor"),and Tri-County Action Program,Inc. ("Lessee") a <br /> Minnesota non-profit corporation,located at 1200 23rd Avenue South,Waite Park,MN <br /> 56387. <br /> WHEREAS, the City entered into an agreement with Tri-CAP for the provision of transit <br /> bus storage and maintenance services on June 2, 2014; and <br /> WHEREAS, the Lessee's current`Hours of Operation'are 7:00 a.m. to 5:00 p.m.; and <br /> WHEREAS, the Lessee has the option to extend service hours from 6:00 a.m. to 6:00 p.m. <br /> with a 30-day written notice; and <br /> WHEREAS, Lessee has provided a 30-day written notice to extend service hours from <br /> 6:00 a.m. to 6:00 p.m.; and <br /> WHEREAS, the parties wish to amend the Agreement; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br /> River,Minnesota, as follows: Section 16: HOURS OF OPERATION is amended to read as <br /> follows: Lessee will operate their business between the hours of 7:00 6:00 a.m. to 5.00 6:00 <br /> p.m. Monday through Friday. Lessee has the option to extend their sefvice hours from 6:00- <br /> a.m. to 6:00 p.m. by providing to Lessor thifty (30) days pnof. <br /> Passed and adopted this Is' day of December, 2014. <br /> John J.
