EXTENSION OF LEASE <br /> THIS EXTENSION OF LEASE ("Extension") is made as of the Pt day of December, <br /> 2014, by and between the CITY OF ELK RIVER, ("Lessor"), and BOY SCOUT TROOP <br /> NOS. 90, 99, AND I 11, BOY SCOUTS OF AMERICA, CHARTERED BY <br /> AMERICAN LEGION POST 112, CHURCH OF ST. ANDREWS, ("Lessee"). <br /> WITNESSETH <br /> WHEREAS, the Lessor and Lessee entered into a Lease ("Lease") dated July 29, 1994 for <br /> certain Premises ("Premises") located at Lot 4, Block 1, Ridgewood East 2nd Addition in the City of <br /> Elk River, County of Sherburne and State of Minnesota, street address 11857 191" '/z Street; and <br /> WHEREAS, under the terms of the Lease, the Lease terminates as of December 1,2014; <br /> and <br /> WHEREAS, Lessor and Lessee desire to extend the term of the Lease pursuant to the <br /> terms, covenants and conditions of this Extension. <br /> NOW, THEREFORE, for One Dollar and other good and valuable consideration, the <br /> parties hereto hereby agree as follows: <br /> 1. Extension of Lease. The term of the Lease is hereby extended for 15 years until <br /> terminated according to the terms hereof. <br /> 2. Rent. The rent during the extended term of this Lease shall be One and 00/100 <br /> Dollar ($1.00) per year payable in advance beginning with January 1, 2015 and payable on the 1s`day <br /> of each year thereafter. Lessor shall pay the "Additional Rent" as set forth in the Lease. <br /> 3. Termination. Notwithstanding any other term of the Lease or this Extension, the <br /> Lease may be terminated by Lessor with or without cause upon ninety (90) days written notice to <br /> Lessee. The Lessor shall give Lessee ninety (90) days written notice of its intention to terminate the <br /> Lease which notice shall give an exact date of termination which shall be the last day of any given <br /> month. <br /> 135607 1 <br />
