Memo to Mayor & City Council/P 04-02 <br />April 19, 2004 <br />Page 7 <br /> <br />the plat should be approved. He believed it complied with the Rlc standards, and that by <br />denying the plat, the Commission is treating this plat different than the adjacent plats. <br /> <br />The Commission voted 5 to 1 to recommend denial of the plat. <br /> <br />Recommendafion <br /> <br />Council member Motin will not be in attendance at tonight's meeting. Approval or denial of <br />the proposed plat for Woodland Hills can be by a simple majority. However, if the Council <br />is tied 2:2 regarding a decision on this plat, staff recommends that the Council table this <br />item. <br /> <br />The Planning Commission recommended denial of the preliminary plat for Woodland Hills <br />based on the following findings: <br /> <br />The physical characteristics of the site, including but not limited to <br />topography, soils, vegetation, susceptibility to erosion and sikation, <br />susceptibility to flooding, and drainage are not suitable for the type and <br />density of development and uses contemplated. <br /> <br />Because of the amount of grading required and the large number of mature <br />trees that will be removed, the proposed subdivision will cause substantial <br />environmental damage <br /> <br />Should the Council approve the preliminary plat, the Council should consider basing that <br />decision of the following findings: <br /> <br />(1) <br /> <br />The proposed subdivision is consistent with the zoning regulations (artide VI of this <br />chapter) and conforms in all respects with all requirements of this Code, including <br />the zoning regulations and this artide. <br /> <br />The proposed subdivision is consistent with all applicable general and specialized <br />city, county, and regional plans, including, but not limited to, the city's <br />comprehensive development plan. <br /> <br />(3) <br /> <br />The physical characteristics of the site, including but not limited to topography, soils, <br />vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and <br />drainage are suitable for the type and density of development and uses contemplated. <br /> <br />The proposed subdivision makes adequate provision for water supply, storm <br />drainage, sewage transportation, erosion control and all other services, facilities and <br />improvements otherwise required in this artide. <br /> <br />(5) The proposed subdivision will not cause substantial environmental damage. <br /> <br />The proposed subdivision will not conflict with easements of record or with <br />easements established by judgment of a court. <br /> <br />S:x~PLANNING\Case Files\2004\P 04-02 Woodland Hills\P04-02cc4-19.doc <br /> <br /> <br />
