Memo to Park and Recreation Commission/p99-3PR
January 13, 1999
Page 2
Park Dedication Requirements
The Subdivision Ordinance does not require a park dedication in this
circumstance as there is no development being proposed at this time.
A park dedication will be required at the time the outlot is replatted.
The first line of the Subdivision Ordinance, section 1008.18 regarding park
dedication states this clearly as follows:
In every plat, replat or subdivision of land to be developed for residential,
commercial....
Recommendation
Staff recommends that the Parks and Recreation recommend neither a cash
or land park dedication until the outlot is platted for residential development.
The new lot being created is really an existing use with no development
occuring at this time.
S
\\elkriver\sys\shrdoc\planning\stevewen\parkmmo\p99-3pr.doc
