As an Interim Use Permit is not a Building Permit, the applicant shall obtain all <br /> required permits, including approvals from the Fire Chief, City Engineer and <br /> Building Official. <br /> 4. The standards for issuance of the Conditional Use Permit (CU 10-22) shall <br /> continue to be maintained. <br /> 5. Due to the industrial nature of the neighborhood, the school recognizes that <br /> noise, odors, truck traffic, and other undesirable effects may be present. <br /> Motion carried 5-0. <br /> 5.2 Request by City of Elk River for an amendment to City's Land Use <br /> Regulations regarding fences, Case No. OA 14-02 — Public Hearing <br /> The staff report was presented by Chris Leeseberg. <br /> Chair Johnson opened the public hearing. There being no public comment, Chair Johnson <br /> closed the public hearing. <br /> Commissioner Petschl asked what criteria triggered the need for a building permit for an <br /> above-ground pool. Mr. Leeseberg stated that he did not recall the exact text,but noted that <br /> the City's criteria is the same as the State of Minnesota (building code), and that if a building <br /> permit is required, a fence is also required. <br /> Motion by Commissioner Konietzko and seconded by Commissioner Petschl to <br /> recommend approval of the request by the City of Elk River for an amendment to the <br /> City's Land Use Regulations regarding below ground pool fencing. The motion <br /> carried 5-0. <br /> 6. General Business —None <br /> 7.1 City Council Liaison Update <br /> Councilmember Burandt updated the Commission on Council action taken on the May 27, <br /> 2014, Planning Commission items. <br /> 7.2 June 25th Parks and Recreation Master Plan Open House <br /> Chris Leeseberg noted that an open house will be held on June 25, 2014 from 5:00 p.m. — <br /> 8:00 p.m. at City Hall to review the Parks and Recreation draft Master Plan. <br /> 8.
