The Contractor may satisfy these requirements through an umbrella policy. If any such insurance is due to expire during the construction period,the Contractor shall not permit the coverage to lapse and new certificates shall be furnished to Owner and CMHP. 4. Lien Waivers The Contractor shall protect,defend and indemnify Owner from any claims of unpaid work, labor,or material. Payment shall not be due until the Contractor has delivered to the Owner complete release of all liens arising out of the Contractor or receipt in full covering all labor and materials for which a lien could be filed, or a bond satisfactory to the Owner indemnifying him/her against any lien. S. Subcontractors and Assignments No subcontractor or assignment of this Contract shall be made without the written consent of the Owner and CMHP. Contractor shall furnish subcontractor lien waiver(s)upon payment. 6. Permits and Codes (a) The Contractor shall secure all necessary permits and licenses required to perform the work called for by this contract, and all such work shall be in compliance with all building code regulations and all ordinances whether or not covered by the specifications and drawings for the work. (b) The Contractor agrees to comply with all applicable local, state, and federal laws, regulations, ordinances, and policies. 7. Equal Employment Opportunity (a) The Contractor shall provide equal opportunity to all persons,without discrimination as to race,color, creed, religion, national origin, sex,marital status,age and status with regard to public assistance or disability. (b) To the extent feasible,the Contractor shall provide opportunities for training and employment to lower income residents of the area with a household income at or below 80%of the area median income as defined by HUD for the Minneapolis-St. Paul- Bloomington, MN-WI MSA, particularly residents of public or federally assisted housing. 8. Proceed to Work and Completion of Work Upon acceptance of this bid and submission of evidence of satisfactory insurance coverage, the work will be started within seven calendar days ONLY AFTER A NOTICE TO PROCEED ORDER is received by the Contractor.The contract shall be fully and satisfactorily completed within 90 working days of the Notice to Proceed Order date.A working day will be considered to be all days except Saturday, Sundays, and legal holidays. Any modification of the above shall be set forth in Article 14 below.
