Memo to Mayor and City Council/ZC 98-9
November 30, 1998
Page 3

vi. A PUD shall be served by adequate
transportation, water, sanitary sewer and drainage
systems.

vii. A PUD shall not adversely affect existing
or proposed parks, schools, streets or other public
facilities.

The Council should also take into consideration the existing conditions
within the area directly and indirectly affected by the proposal, the
conservation of property values, the use to which the property affected is
being devoted at the time and the relevant portions of the land use plan.

Approval of the rezoning request will include approval of the concept plan for
the PUD zoning district and approval of generalized land uses to be
permitted in the PUD zoning district.

Planning Commission Meeting

At the Planning Commission meeting held on November 24, 1998 no one
spoke at the public hearing.

Recommendation

Staff and the Planning Commission feel the applicant has met the criteria for
rezoning to PUD and recommends the City Council approve the attached
Ordinance No. 98- __ rezoning certain property to PUD based on the
following findings:

1. The proposed rezoning complies with the regulations set forth in Section
900.12(17).

2. The rezoning is consistent with the Comprehensive Land Use Plan
designation of HC (Highway Commercial).

3. Times and conditions have changed to warrant the development of this
property as a PUD.

4. The proposed PUD zoning is compatible with the adjacent zoning
districts.

5. The property is within the urban service area and is able to be serviced by
municipal sewer and water.

\\elkriver\sys\shrdoc\planning\scott\zc98-9cc.doc
