Memo to Mayor and City Coundl/Morcon <br />Februar7 9, 2004 <br />Page 3 <br /> <br />History <br /> <br />Brentwood Plat <br /> <br />The Brentwood subdivision was approved in 1980 and is comprised of 101 single-family lots <br />averaging approximately 2 - 2-1/2 acres in size. Over the years there has been much <br />discussion regarding the protective covenants of the Brentwood subdivision. A copy of the <br />Brentwood protective covenants is attached for the Council's information. It clearly <br />indicates that "no lot, other than Oudot A, shall be used except for residential purposes." <br />Staff's interpretation of that covenant is that Oudot A may be used for commercial <br />purposes, if approved by the City. In 1999, k appears that the owner attempted to register <br />the title and to clarify the owner's intent in regards to Outlot A. <br /> <br />1994 Land Use and Zone Change Request <br /> <br />The owner submitted this exact request in 1994 but withdrew the request, as the City was <br />undertaking the 1995 Comprehensive Plan update. At that time, the Planning Commission <br />voted to deny the request on a number of points including the impacts to adjacent residential <br />areas, traffic issues (lack of a signalized intersection at 197~h Avenue and Highway 169) and <br />that the Growth Management Han was being updated. <br /> <br />1995 Land Use Request <br /> <br />In 1995 the owner submitted a request for a land use amendment to Highway Business, a <br />zone change to Planned Unit Development, and a Conditional Use Permit. At that time, the <br />Planned Unit Development was intended to provide additional commercial uses on the ske. <br />This request again was withdrawn by the applicant until some unknown future date. <br /> <br />1997 Strategic Economic Development Planning Task Force <br /> <br />As a result of the 1995 Growth Management Plan (Comprehensive Plan) update, the <br />Economic Development Authority authorized the formation of a Strategic Economic <br />Development Planning Task Force. The purpose of the Task Force was to identify potential <br />sites for industrial and business park development. The Task Force identified eight sites <br />scattered throughout the City for potential industrial and business park development. One <br />of the sites under consideration was Outlot A of Brentwood. Six of the eight sites <br />recommended by the Strategic Planning Task Force were rezoned to business park, however <br />as noted in the EDA Minutes from 1997, Area #2 known as Outlot A of Brentwood was <br />not pursued due to the significant public opposition anticipated in trying to develop it as an <br />industrial or business park site. <br /> <br />2002- 2003 Comprehensive Plan Process <br /> <br />As the Council is aware, the City has undertaken a process to amend the Comprehensive <br />Plan for the City.
