Memo to Mayor and City Coundl/Morcon
Februar7 9, 2004
Page 3

History

Brentwood Plat

The Brentwood subdivision was approved in 1980 and is comprised of 101 single-family lots
averaging approximately 2 - 2-1/2 acres in size. Over the years there has been much
discussion regarding the protective covenants of the Brentwood subdivision. A copy of the
Brentwood protective covenants is attached for the Council's information. It clearly
indicates that "no lot, other than Oudot A, shall be used except for residential purposes."
Staff's interpretation of that covenant is that Oudot A may be used for commercial
purposes, if approved by the City. In 1999, k appears that the owner attempted to register
the title and to clarify the owner's intent in regards to Outlot A.

1994 Land Use and Zone Change Request

The owner submitted this exact request in 1994 but withdrew the request, as the City was
undertaking the 1995 Comprehensive Plan update. At that time, the Planning Commission
voted to deny the request on a number of points including the impacts to adjacent residential
areas, traffic issues (lack of a signalized intersection at 197~h Avenue and Highway 169) and
that the Growth Management Han was being updated.

1995 Land Use Request

In 1995 the owner submitted a request for a land use amendment to Highway Business, a
zone change to Planned Unit Development, and a Conditional Use Permit. At that time, the
Planned Unit Development was intended to provide additional commercial uses on the ske.
This request again was withdrawn by the applicant until some unknown future date.

1997 Strategic Economic Development Planning Task Force

As a result of the 1995 Growth Management Plan (Comprehensive Plan) update, the
Economic Development Authority authorized the formation of a Strategic Economic
Development Planning Task Force. The purpose of the Task Force was to identify potential
sites for industrial and business park development. The Task Force identified eight sites
scattered throughout the City for potential industrial and business park development. One
of the sites under consideration was Outlot A of Brentwood. Six of the eight sites
recommended by the Strategic Planning Task Force were rezoned to business park, however
as noted in the EDA Minutes from 1997, Area #2 known as Outlot A of Brentwood was
not pursued due to the significant public opposition anticipated in trying to develop it as an
industrial or business park site.

2002- 2003 Comprehensive Plan Process

As the Council is aware, the City has undertaken a process to amend the Comprehensive
Plan for the City. This plan anticipates the complete City build-out and looks as far into the
future as 2020 - 2025.

S:\PLANNING\Case Files\2003\P 03-16 Elk Ridge Center~P03-16CC2-9.doc
