to be removed <br /> Underlines to be added <br /> (4) The City's zoning regulations include the regulation of Signs in an effort to <br /> provide adequate means of expression and to promote the economic viability <br /> of the business community,while protecting the City and its citizens from a <br /> proliferation of Signs of a type, size,location,number and character that <br /> would adversely impact upon the aesthetics of the community and threaten <br /> the health, safety and welfare of the community. The regulation of the <br /> physical characteristics of Signs within the City has a positive impact on <br /> traffic safety and the appearance of the community. <br /> § 30-853, Compliance with applicable regulations: <br /> All Signs hereafter erected or maintained shall conform with the provisions of this subdivision and <br /> other ordinances and regulations of the city. <br /> § 30-854 (a) — (e), Nonconforming Signs <br /> (a) Eligibility for legal nonconforming status. Existing Signs which do not conform to the <br /> current provisions of this subdivision shall be "legal nonconforming" Signs,provided <br /> that the Sign was authorized by a valid permit,variance, or complied with all then <br /> applicable laws at the time the Sign was installed. <br /> (b) Loss of legal nonconforming status. A legal nonconforming Sign will lose this designation <br /> if the Sign is removed, abandoned, or its use discontinues for a period of 12 months <br /> or more <br /> (c) Maintenance and repair. A legal nonconforming Sign is subject to all requirements of <br /> this subdivision regarding safety, maintenance, and repair. <br /> (d) Relocation or alteration. The city council may,upon application of a property owner, <br /> permit the alteration or relocation of a legal nonconforming Sign if, after a public <br /> hearing by the planning commission and city council, the council determines that <br /> total compliance with the current Sign regulations is not reasonable but the alteration <br /> or relocation of the nonconforming Signs is in greater conformity with the existing <br /> Sign regulations and is in the best interest of the community. <br /> (e) No expansion. No legal non-conforming Sign shall be expanded or enlarged in any <br /> respect. <br /> § 30-855, Appeals <br /> Appeals from any decision rendered under this subdivision may be made as provided in subdivision <br /> II of division 2 of this article. <br /> 5 <br />
