December 3,2013 , <br /> Page 2 <br /> was still.in.effect.Therefore,no new application for impacts or mitigation is needed by the <br /> applicant and the past application and approval is still valid. <br /> Different Operator <br /> The TEP indicated that the change in ownership was not an issue and this could just be <br /> documented through this process. The applicant has submitted the same mining and <br /> mitigation plans showing Plaisted Companies as the applicant on the plan sheets dated <br /> November 18, 2013 and attached. Therefore, Plaisted Companies is now the approved <br /> applicant for the WCA application and approval. <br /> Wetland Delineation <br /> The wetlands were redelineated in 2013 and reviewed by WSB on behalf of the City of Elk <br /> River. This delineation was approved on October 25, 2013. Based on this delineation, <br /> additional wetlands were identified that did not exist in the previously approved project <br /> plans. These wetlands have been determined to be incidental as they were created as part <br /> of past approved mining activities within the site. No mitigation is required for impact to <br /> these incidental wetlands. These incidental wetlands include Wetland 6 and 10 as noted in <br /> the Wetland Delineation Report and the letter dated December 3, 2013 from Anderson <br /> Engineering (attached). <br /> Surely <br /> As part of the City's review of the CUP for the project, a surety will be required for the <br /> wetland mitigation. This amount will be included in the CUP process. <br /> Expiration Date <br /> The WCA Notice of Decision has been reissued for clarity for this project (see attached), <br /> This decision simply affirms that the past 2004 approval is still valid. In addition, an <br /> expiration of the NOD has now been added to the approval_to run concurrent with the <br /> sunset date of the CUP. <br /> Possibility of Draining Additional Wetland <br /> The possibility of draining adjacent wetland with the project was investigated in 2004 and <br /> the documentation indicates that this type of impact is not anticipated to occur. However, <br /> if it does occur,the applicant will be responsible for obtaining additional wetland <br /> mitigation either on-site or through the purchase of wetland bank credits. This has been <br /> added to the NOD. <br /> This concludes the summary of the 2013 Plaisted Aggregate Mining plan with respect to the <br /> WCA approval for the City as the LGU. The City Council is anticipated to review this <br /> information at the CUP application at an upcoming December meeting.
