I forwarded the staff report & attachments to BWB for review. Except for <br /> a call I placed to Todd a few weeks back when BWB received notice, we haven't had any <br /> discussion on haul routes. Attached is the graphic you forwarded me &the current 2011 <br /> easement docs you asked for. <br /> Per our talk, BWB is requesting you incorporate the following items into the City's review & <br /> conditions: <br /> 1. The existing easement (blue on the attached graphic) is specifically for the benefit of the <br /> BWB parcels (graphic label 3, 4, & 5) & Outlot B (graphic label 2) -- not the parcels to the <br /> north. <br /> 2. BWB & ERX/Plaisted have been working together on a separate agreement over the past <br /> several months (noted in red on the attached graphic you put together) —this <br /> agreement does not address the existing N-S easement. BWB is not necessarily <br /> opposed to the haul route proposed by Plaisted (colored blue on the graphic), but <br /> further discussion & easement rights need to be defined/granted. Easement C (the <br /> easterly portion of what is colored red on the graphic) is proposed to be granted, but <br /> was originally intended as a means for temporary access of parcel 2 to new 215th— not <br /> as a semi-permanent easement or for mining operations/ heavy hauling. It is <br /> anticipated that there will be future mining in this area. <br /> 3.
