Approve,by motion,the Conditional Use Permit with the following conditions: <br /> 1. Submit and receive approval from staff, both landscape and architectural plans addressing staff <br /> comments below,regarding placement of the patio, fence, and trees. <br /> 2. Submit and receive approval from staff, a unified landscape plan for the entire 10.4 acre parcel. <br /> 3. Submit a site plan showing the retaining wall near Yankton Street moved out of the right-of- <br /> way, addressing staffs comments from letter dated September 17, 2013. <br /> 4. A PUD agreement shall be developed and signed by both parties prior to issuance of a building <br /> permit. <br /> Background <br /> The applicant is requesting Preliminary Plat, Final Plat, and Conditional Use Permit (CUP) approval to <br /> subdivide 10.4 acres into two lots and develop these as a Planned Unit Development. Proposed <br /> development includes a 20-unit memory care facility on 1.08 acres, and a 7.84 acre oudot for future <br /> development. Future development is anticipated to be a 48-unit senior housing complex with multiple <br /> townhome style structures.Access to the project will be from an extension of Yankton Street, and there <br /> are no proposed access changes along Highway 10. <br /> Planning Commission <br /> The Planning Commission asked why a temporary cul-de-sac is proposed instead of making the <br /> connection to Waco Street. Staff noted that the parcel between the Heritage Maples facility and Waco is <br /> privately owned and that the city or the developer has no plans to purchase road right-of-way at this time. <br /> The Commission had no other concerns with the requests and unanimously recommended approval of <br /> the Preliminary Plat and the Conditional Use Permit. <br /> Public Hearing <br /> The applicant described the project asked for clarification on the landscape plan requirements. Staff <br /> explained that for final approval, the city must receive a unified landscape plan for the entire Planned <br /> Unit Development. Staff noted that this does not mean the landscaping must be installed upon approval, <br /> but that it aids in the understanding of future plans. The applicant also stated that she is okay with the <br /> conditions. The applicant questioned the need to revise the plan for the patio.
