t <br /> River <br /> Resolution I3-71 <br /> A Resolution of the City of Elk River Adopting and Levying Assessments for Costs <br /> Incurred to Connect to City Water and Sanitary Sewer Lines <br /> WHEREAS, Minnesota Statutes Section 429.101 authorizes the municipality to levy an assessment <br /> against the property for unpaid special charges;and <br /> WHEREAS, all of the property owners have requested that the city allow them to connect to the <br /> sanitary sewer and water lines which adjoin their property; and <br /> WHEREAS, the property owners have signed a"Petition,Waiver and Agreement for Payment of <br /> the Cost of Installation and Connection of, or Repairs to,Private Utility Lines and Assessment of <br /> Amounts Paid as a Special Charge Under Minnesota Statutes 429.101" to allow the connection costs <br /> to be levied as a an assessment against their property; and <br /> WHEREAS, state law does not require a public hearing or notice before levying such assessments. <br /> • NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br /> Minnesota, as follows: The parcels and amounts listed on Exhibit A attached hereto, are correct <br /> and made a part hereof, are to be levied, and are to be certified to the Sherburne County Auditor. <br /> Passed and adopted this 18th day of November 2013. <br /> \ • I , , <br /> aca.', ,— A <br /> J o h1 J.
