-'ity of <br /> <br />River <br /> <br />MEMORANDUM <br /> <br />Item # 4.7. <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />Mayor and City Council <br /> <br />Pat Klaers, City Administrator~__~ <br />September 21, 1998 <br /> <br />School Street Improvement Project <br /> <br />City Engineer Terry Maurer will be in attendance at this meeting to discuss <br />this agenda item. <br /> <br />In late August and early September, a great deal of discussion took place <br />regarding doing the public improvement work on School Street, west of <br />Proctor Avenue, in 1999. Eventually, the school and city both agreed that <br />this project should happen. Discussion then took place regarding the method <br />of payment, which was cash vs. assessments, and how this related to the <br />contractor's contractual completion date and the required timetable for <br />assessment public hearings. Eventually, what happened was that the city <br />published public hearing notices for September 21 for the project and <br />assessment public hearing for work west of Proctor on School Street. <br />Following the publication, the school agreed to pay up front under certain <br />conditions, which subsequently was accepted by the City Council. This up <br />front payment was necessary as, if we were required to go through the <br />assessment public hearing process, the contractor would not have been <br />obligated to honor his bid and consequently, staff did not believe this project <br />would have happened this year. The result of this project not happening in <br />1999 would have been that the school would have had to restore the road as <br />it was disturbed for the ALC storm drainage work. <br /> <br />The above comments is kind of a cumbersome narrative, but the end result is <br />that the scheduled public hearings are not required and the work has been <br />nearly completed and a bill has been sent to the school district for one-half of <br />the project. <br /> <br />No action is necessary for this agenda item. As we are on Cable TV, the <br />Council should acknowledge that no public hearings are needed for this 1999 <br />project. <br /> <br />13065 Orono Parkway · P.O.
