City of <br /> Elk=' Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 4.6 <br /> Agenda Section Meeting Date Prepared by <br /> Consent October 21, 2013 Bob Kluntz, Police Captain <br /> Item Description Reviewed by <br /> Ordinance Amendment: Redemption and Cal Portner, City Administrator <br /> Disposition of Impounded Animals Reviewed by <br /> Action Requested <br /> Approve by motion an ordinance amendment regarding the redemption and disposition of impounded <br /> animals. <br /> Background/Discussion <br /> A recent change in the business practices of the impound center used by the city prompted staff to review <br /> the state statutes and ordinances regulating animal impound periods. It was discovered that state statute <br /> and city ordinance had different requirements and the ordinance actually specified that an impounded <br /> animal be held for a longer period of time than is required by state statute. <br /> A number of other communities were polled and it was found that most have ordinance language that <br /> mirrors state statute. A request was made to the city attorney,who then drafted language changes <br /> reflecting the intent of Minnesota State Statutes, Section 346.47, subd.2,which regulates the impound <br /> times for animals. <br /> Financial Impact <br /> A minor publishing fee will be incurred by the city,but an overall savings will be realized due to the <br /> decrease in the time required to hold impounded animals. <br /> Attachments <br /> ■ Ordinance revision of Section 10-53 (b) <br /> P a w E A E U s r <br /> NaA f RE] <br />
